1. The Agreement
These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and InterviewOra ("InterviewOra", "we", "our", or "us") and govern your access to and use of interviewora.com, our desktop apps for macOS and Windows, our APIs, and any related services (collectively, the "Service").
By creating an account, downloading the app, or using any part of the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility & Accounts
- You must be at least 16 years old, or the age of digital consent in your country if higher, to use the Service.
- You must provide accurate registration information and keep it current.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- You must notify us immediately of any unauthorized access or security breach.
- One human, one account. Sharing accounts is prohibited.
3. The Service
InterviewOra is a real-time AI interview assistant that listens to interview audio on your device and streams suggested answers to help you prepare for and perform during job interviews. The Service includes mock interview practice, resume tailoring, AI career coaching, and related tools.
4. License to Use
Subject to these Terms and timely payment of all fees, InterviewOra grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service for your personal, non-commercial use. You may not resell, sublicense, or otherwise commercially exploit the Service without our prior written consent.
5. Subscriptions & Billing
- Paid plans are billed in advance on a recurring basis (monthly or annual) until cancelled.
- Prices are listed on our Pricing page and may be updated with at least 30 days' notice for existing subscribers.
- All fees are exclusive of taxes; you are responsible for any applicable VAT, GST, or sales tax.
- Payments are processed by our merchant of record and payment processors. By subscribing you authorize recurring charges to your selected payment method.
- If a charge fails, we may retry the charge and suspend access until payment is received.
- You can cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.
6. Refund Policy
We want you to be confident in your purchase. Our refund policy is as follows:
- Pro (monthly): refundable within 7 days of the initial subscription if you have not used the Service in a real interview.
- Annual: refundable within 14 days of purchase, prorated for any usage.
- Permanent Access: refundable within 14 days of purchase if you have not used the Service in a real interview.
- Free tier: 10 free minutes, no payment, no refund needed.
- Refunds are returned to the original payment method within 5 to 10 business days.
- To request a refund, contact billing@interviewora.com with your account email and order reference.
- Statutory rights: nothing in this section limits any non-waivable consumer rights you have under applicable law (including the EU 14-day right of withdrawal).
7. Free Tier
The free tier gives every new account 10 minutes of real-time interview help at no cost. No payment method is required. The free tier is limited to one account per person and may not be combined with other offers. We reserve the right to revoke the free tier in cases of abuse.
8. Acceptable Use
You agree not to:
- Use the Service during any real, live employer interview unless the employer has explicitly authorized AI assistance in writing.
- Use the Service to commit fraud, deceive an employer in a way that violates applicable law, or misrepresent your identity in regulated hiring processes (for example, security clearance roles).
- Use the Service for any purpose that violates the rules of a specific employer's agreement that you have explicitly accepted in writing where such use is prohibited.
- Attempt to reverse engineer, decompile, or extract the source code of the Service, except where allowed by law.
- Resell, rent, lease, or sublicense the Service without our prior written consent.
- Upload malware, scrape the Service, or interfere with its operation.
- Use the Service to generate content that is illegal, defamatory, harassing, hateful, or sexually explicit involving minors.
- Bypass any security or rate-limiting features.
- Use the Service in jurisdictions where it is illegal.
9. User Content & Resumes
You retain ownership of all content you upload (resumes, job descriptions, notes). You grant InterviewOra a worldwide, royalty-free license to host, process, and display that content solely to operate the Service for you. We do not use your content to train machine learning models.
You represent that you have the right to upload any content you submit and that it does not infringe any third-party rights.
10. AI-Generated Output
- Output generated by the Service is provided as a suggestion. You are responsible for reviewing it before relying on it.
- AI output may contain inaccuracies, omissions, or fabrications. Always verify critical information.
- Subject to your compliance with these Terms, you own the rights to output generated for you, to the extent permitted by law.
- We make no guarantee that the same prompt will produce identical output for different users.
11. Intellectual Property
The Service, including all software, designs, text, graphics, logos, and trademarks, is owned by InterviewOra or our licensors and is protected by intellectual property laws. Except for the limited license in Section 4, no rights are granted to you.
"InterviewOra" and the InterviewOra logo are trademarks of InterviewOra. You may not use them without our prior written consent.
12. Third-Party Platforms
The Service interacts with third-party meeting platforms (Zoom, Google Meet, Microsoft Teams, HackerRank, CoderPad, CodeSignal, Karat, and others). We are not affiliated with, endorsed by, or sponsored by these platforms. Your use of those platforms is governed by their own terms, and you are responsible for complying with them.
13. Candidate Compliance
You are solely responsible for ensuring that your use of the Service complies with the rules of the specific interview, the employer's policies that you have explicitly agreed to, and all applicable laws in your jurisdiction. InterviewOra does not provide legal advice. If a specific employer's process prohibits the use of AI assistance and you have agreed to that prohibition, do not use the Service in that interview.
14. Suspension & Termination
- You may terminate your account at any time from your dashboard.
- We may suspend or terminate your access for violation of these Terms, suspected fraud, abusive behavior, or non-payment.
- We may discontinue the Service or any feature with reasonable notice.
- Upon termination, your license to use the Service ends and we may delete your data subject to our retention policy.
- Sections that by their nature should survive (including IP, disclaimers, liability, indemnification, governing law, and arbitration) survive termination.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL RESULT IN A JOB OFFER.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTERVIEWORA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOST OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless InterviewOra and its affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service in violation of these Terms, (b) your violation of any law or third-party right, including any agreement with an employer that prohibits AI assistance and that you accepted, or (c) any content you upload.
18. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19. Arbitration & Class Action Waiver
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be finally resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration shall be Wilmington, Delaware. Each party shall bear its own costs unless the arbitrator determines otherwise.
YOU AND INTERVIEWORA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
You may opt out of this arbitration agreement by sending written notice to legal@interviewora.com within 30 days of first accepting these Terms. Nothing in this Section prevents either party from seeking injunctive relief in a court of competent jurisdiction. EU consumers retain the right to bring proceedings in the courts of their country of residence.
20. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
